Consumer Protection Council  under (CPA) Consumer Protection Act 2019

The Consumer Protection Council is a consumer protection agency of India established under Consumer Protection Act 2019 to promote and protect consumers’ interests. The purpose of the Council is to achieve success ‘when Indian consumers can be described as well protected, getting their money’s worth, knowledgeable about the marketplace and its mechanisms, vigilant about what takes place in it, assertive about their rights and conscious of their responsibilities. Its core activities are: to inform consumers; to eliminate hazardous products from the market and ensure that products and services comply with required standards and to receive, mediate and provide redress to consumer complaints.

Introduction

The Consumer Protection Act, 1986 provides better protection to the interest of consumers. To achieve the objective of the Act Central and State protections councils are formed under the Act. Such councils helps the consumers and act in the interest of consumers. The Consumer Protection Councils set up at national and state levels (Section 6 of Consumer Protection Act).

The Consumer Protection Act 2019 has established  Consumer Protection Councils at the Central and State levels for protecting consumer’s interests and spreading awareness. The objects of the Councils, as per the Act, shall be to promote and protect the rights of the consumers such as:

  • protection from marketing hazardous goods and services.
  • informed about the quality, quantity, potency, purity, standard, and price of goods or services,
  • as to protect the consumer against unfair trade practices;
  • access to a variety of goods and also services at competitive prices;
  • The right to heard
  • to be assured that consumer’s interests receive due consideration
  • The right to seek redressal against unfair trade practices or also restrictive trade practices or also unscrupulous exploitation of consumers and
  • The right to consumer education.

Central Protection Council

The Consumer Protection Act gives the powers to the Central Government to establish a Central Consumer Protection Council. It consists of a chairman and such number of official and also non-official members. The chairman of the council is the minister in charge of the central government.  Under the Consumer Protection Council Rules 1987, the membership of the Council is restricted to 150 members. Such 150 members include the Central Minister in charge of Consumer Affairs as the Chairman. The term of the Council is three years. The central government may also constitute a standing working group from members of the council to monitor the implementation of the recommendations of the Council. The Council shall at least meet once a year.

State Consumer Protection Council

The Consumer Protection Act gives the powers to the State Government to establish a State Consumer Protection Council.  It consists of a chairman and such number of official and also non-official and also members ten nominees of the Central Government. The chairman of the council is the minister in charge of the State government. The State Council shall at least meet once a year. Consumer Protection Council CPA 2019

District Consumer Protection Council

In order to promote and protect the rights of consumers, within the district, the Consumer Protection Act, provides for the establishment of a District Consumer Protection Council in every district. It shall consist of Chairman and also a number of other official and also non-official members representing such interests of the consumer. They shall at least meet once a year. The Chairman shall decide the time and place of the meeting.
