About National Company Law Tribunal (NCLT) 

The National Company Law Tribunal owes its creation to the Eradi Committee. It serves as a quasi-judicial authority which was established by the Central Government of India in 2016 under Section 408 of the Companies Act of 2013. It was set up mainly to govern the companies registered in India and handle corporate disputes that arise under the Companies Act. There are total 13 National Company Law Tribunal benches established in India, with two in Delhi and one each in Ahmedabad, Allahabad, Bengaluru, Chandigarh, Chennai, Guwahati, Hyderabad, Jaipur, Kochi, Kolkata, and Mumbai. A committee led by the Secretary of the Ministry of Corporate Affairs selects the members for these benches. The Company Law Board which was set up under the Companies Act, 1956 stands dissolved with the establishment of National Company Law Tribunal and National Company Law Appellate Tribunal. The National Company Law Tribunal is a specialized court that reduces the multiplicity of litigation before different forums and courts. The tribunal provides a quicker and more efficient mode of settling company disputes as both judiciary members as well as technical members are involved while arriving at a decision in the tribunal. The National Company Law Tribunal concerns itself with cases that involve registration/de-registration of companies, transfer of shares, mismanagement of affairs, freezing of assets, deposits, conversion of a public limited company into a private one, so on and so forth.

Rules and Regulations of National Company Law Tribunal (NCLT)

The Tribunal largely follows the rules laid down in the Code of Civil procedure, while at the same time being guided by the principles of the natural justice. Cases that fall under the jurisdiction of the National Company Law Tribunal cannot be tried by any other civil court. Any appeal against the decision of the Tribunal can be raised at the National Company Law Appellate Tribunal. The appeal has to be filed within 45 days from the date of the decision of the Tribunal.
